David Bergstein Sues His Former Attorney for $50 Million
The David Bergstein lawsuit circus is continuing to grow to incorporate another former attorney for that embattled film executive. Bergstein as well as an entity known as Graybox LLC on Monday prosecuted Teri Zimon, who formerly symbolized his interests and it is now charged with using personal data to assist the creditors within the involuntary personal bankruptcy proceeding against him. New Award Proving Popular At VMAs
NEW YORK, N.Y. -- When Chicago-based rock act Rise Against began writing a song about suicide among gay teens, the bands lead singer tried to block out the event that inspired the tune the death of a gay friend. His loss was something big to me, said Tim McIlrath. But the band members wanted to get out the message, so they made a gripping video for Make It Stop (Septembers Children) featuring three teens bullied and at the brink of suicide. Now the video is competing in a new category at the MTV Video Music Awards: the best video with a message award. It highlights music videos sending messages of positivity and self-empowerment and raising awareness about social issues that affect todays youth. I hope that category sticks around and I hope it gives artists something to aim for, said McIlrath, who teamed with the It Gets Better Project for the music video. MTV President Stephen Friedman says the new category is proving popular among voters this year. I have to tell you in the voting, this category catapulted. It was among the top three or four categories millions and millions of people voted on this, Friedman said. It shows not only an interest from the artist, but also more importantly for the audience. Other nominees in the category include Lady Gagas Born This Way, Taylor Swifts Mean, Katy Perrys Firework, Pinks (Expletive) Perfect, and Eminem and Rihannas Love the Way You Lie. Friedman says he hopes this will be an ongoing category from here on out. McIlrath said he thought about writing Make It Stop when a gay fan told him she wasnt sure where the band stood on gay rights. McIlrath says the song and the MTV nomination is helping raise their profile. Were not a band who really aims for the VMAs, Ill be honest. Like, were not really a band that traffics on the Billboard chart and MTV and VMAs and that kind of thing, we never really relied on that, he said. When the video came out, CNN called me and Fox had me on, NBC had me on, like these little news blips, and Ive never even done that type of stuff before. Dave Meyers, the music video director of the Pink and Perry videos nominated in the new category, said making a video with a message can be difficult. Whats challenging for me is I dont want to seem like Im talking down to the audience that Im not preaching the message, that Im asking them to come on a ride that is not one-dimensional, he said. Sometimes I think message-y videos can be too message-y. Meyers, who has directed videos for Missy Elliott, Dave Matthews Band and Britney Spears, says taking home the moon man for the message award would be more gratifying than some of his other wins. After 15 years of nominations and countless wins, this actually has a lot of meaning to me, Meyers said. This is MTV saying, We as an organization think these videos deserve special acknowledgment versus a popularity contest, which is what a lot of the other categories tend to be. The Perry, Eminem and Lady Gaga videos nominated for best video with a message are also up for other awards. Hurricane Irene stymies B.O. forecasts
'The Help'While Disney's "The Help" looks to hold in the No. 1 spot, Hurricane Irene is making weekend box office predictions tough. Many East Coast theaters said they would shutter over the weekend, including Clearview Cinemas, which was planning to close its 18 Gotham, two Pennsylvania and 25 New Jersey locations Saturday and Sunday, according to an email to staff. The theater chain plans to reopen its locations Monday and has not yet announced plans to close any locations tonight. New York alone makes up 6% of the nation's box office market, and other theater chains are watching the weather closely to determine their plans. While AMC Theaters announced closings of two theaters in Virginia, a rep for the company told Variety that execs at the plex chain are closely monitoring the situation and are making closure decisions on a theater-by-theater basis. AMC plans to post all closings to its website at AMCtheaters.com/hurricaneirene. The hurricane's sweep through the East Coast has rendered the usual weekend B.O. scene unpredictable. B.O. observers said they remain confident on the top spot -- with "The Help" leading the frame -- but that the other berths are harder to call. The Weinstein Company's "Our Idiot Brother" and Sony's "Columbiana" look to be the closest pics, pulling ahead of FilmDistrict's "Don't Be Afraid of the Dark." Pre-hurricane, B.O. watchers had said that a film would have to pull in $15 million to be this frame's top-grosser. Cody Horn likes 'Magic Mike'
Cody Horn has landed one of the female leads in Steven Soderbergh's male stripper pic "Magic Mike," joining Channing Tatum, Alex Pettyfer, Matthew McConaugey and Matt Bomer. Pic follows a young male stripper (Pettyfer) learning the ropes from a veteran (Tatum), and draws upon Tatum's previous life in the trade. Horn will play Paige, the older sister to Pettyfer's character. Nick Wechsler and Gregory Jacobs are producing with Tatum and his 33andOut Prods. partner Reid Carolin, who's also scripting the project. After initially casting Pettyfer and Tatum as leads, Soderbergh took his time with the remaining cast while Carolin touched up the script. In recent weeks, the cast has filled out with "True Blood"'s Joe Manganiello and Riley Keough also joining the cast. Horn, whose casting was first reported Monday by IndieWIRE blog The Playlist, is the daughter of former Warner Bros. prexy Alan Horn. Lawsuit Over Bret Michaels Concert Reveals His Food and Beverage Demands
Getty Bret Michaels is suing a tour cruise company and two promoters for allegedly breaching a contract where the rocker and reality TV star was going to get $750,000 to perform on a "Super Cruise." This isn't the first time that Michaels has allegedly been stiffed over a cancelled show. In fact, almost a year ago to this day, Michaels sued a promoter for a failed concert in Syracuse. He recently emerged partially victorious in that case. Michaels may hope that his newest lawsuit goes as well as the last one. Last August, the Poison singer sued Michael Banks and Aloha Events after showing up in Syracuse only to find his gig had been cancelled. After fans started besieging a local news outlet and the state's attorney general with news of the cancelled concert and demanding a refund, the promoter allegedly blamed the cancellation on Michaels himself, saying he had a conflicting TV appearance. Banks filed an answer to Michaels' complaint that disputed the existence of a contract and any comments to a TV station, but Aloha Events was a no-show. Today, New York federal judge David Hurd found that Aloha Events was in default as a result of "having failed to plead or otherwise defend in this action" and ordered the company to pay out $95,000. Michaels has now turned his attention to another alleged perpetrator of a "bait and switch" scheme, alleging in his latestcomplaint that defendants Shoreline Tours, Tim Towle and Willie Donwell never had any intention of paying his $750,000 fee and then tried to coerce him to reduce it to $400,000. The singer is now seeking at least $50,000 in damages. Not for nothing, but one of the fun things about these types of cases is getting a peek at all the things that rock stars demand when putting up a concert. Zack Snyder to direct 'Photograph'
Zack Snyder is planning to direct "The Last Photograph," the Afghanistan-set story that he's been developing for the past four years.The director's currently in production on Warner Bros.' "Man of Steel," which has a June 2013 release date.Snyder originated the idea for "The Last Photograph" in 2007 with a story revolving around a photograph that becomes the catalyst for a journey two men undertake through war-torn Afghanistan.
